The decision passed by the International Court of Justice in The Hague in February 2009, which finally determined the status of the Snake Island and the delimitation of the borders of Ukraine’s and Romania’s exclusive economic zones on the Black Sea’s continental shelf removed the major dispute from the agenda of relations between the two countries but it failed to reduce their mutual distrust.

On 17 November, the Supreme Council adopted new regulations for parliamentary elections. Thus a new mixed system has been introduced, which imposes a ban on creating electoral blocs and raises the electoral threshold from 3% to 5%. The new electoral regulations, furthermore, provide for numerous procedural changes thus significantly reducing the possibilities of abuses during elections.

Even if the negotiations are formally concluded, then the case of Yulia Tymoshenko will have crucial significance for the Association Agreement’s coming into force. EU representatives have informally indicated that if the main opposition leader remains in custody, the agreement will not be initialled. Meanwhile, on 15 November the Ukrainian parliament rejected an amendment decriminalising the article of the Criminal Code under which Tymoshenko was sentenced.

The conclusion of the DCFTA negotiations were in doubt until the last minute because of the sentencing of former Prime Minister Yulia Tymoshenko to seven years’ imprisonment. On 26 October, the 20th round of negotiations on the political points of the association agreement was held in Kyiv; one point of contention therein is Kyiv’s request for a note on Ukraine’s prospects for EU membership.

On 20 October, the Deputy Prime Minister of Ukraine Andriy Kluyev and the EU Commissioner for Trade Karel De Gucht announced that the parties have concluded negotiations on a Deep and Comprehensive Free Trade Area (DCFTA). The Commissioner said that this means the technical completion of negotiations on the Association Agreement, which includes the DCFTA, could be achieved by the end of the year.

On 11 October, the former Prime Minister of Ukraine, Yulia Tymoshenko, was convicted and sentenced to seven years’ imprisonment. In addition, the court ruled that she was forbidden from holding public office for three years, and was obliged to pay damages to Naftohaz amounting to 1.5 billion hryvnia. The court also upheld her detention on remand while she appeals, which her defence team has already announced she will do.

Some details of the negotiations were revealed on 26 September by the Ukrainian Prime Minister Mykola Azarov, according to whom Russia has agreed to cut gas prices for individual consumers in Ukraine, in exchange for reducing the rates for the transit of Russian gas to cost level. Moscow and Kyiv have agreed to create a Ukrainian-Russian-EU consortium to manage Ukraine's gas transit pipelines. The head of Gazprom, Alexey Miller, said that the parties had indeed made progress in negotiations but many issues remained unconfirmed yet.
